Spousal Sponsorship

Spousal Sponsorship Canada — Reunite Your Family

Bringing your spouse or partner to Canada — or securing their permanent residence — is one of the most personal and meaningful decisions you will make. Canada’s spousal sponsorship programme allows Canadian citizens and permanent residents to sponsor their spouse, common-law partner, or conjugal partner for permanent residence.

At NextArrival Immigration, our immigration lawyer guides families through both inland and outland spousal sponsorship with thorough case preparation, clear communication, and personal attention to every detail.

Offices in Scarborough (Toronto) and Moncton, NB. Serving clients across Canada and internationally.

Who Can Apply for Spousal Sponsorship?

You can sponsor if you are:
  • A Canadian citizen (18 years of age or older)
  • A permanent resident of Canada (18 years of age or older)
  • Residing in Canada (some exceptions apply for Canadian citizens living abroad)
You can be sponsored if you are:
  • A Spouse: Legally married to the sponsor
  • A Common-Law Partner: Living together in a conjugal relationship for at least 12 consecutive months
  • A Conjugal Partner: in a committed relationship for at least 12 months but unable to cohabit due to immigration or other barriers

Inland Spousal Sponsorship vs. Outland Spousal Sponsorship

Understanding the difference between inland and outland sponsorship is essential for choosing the right pathway.

Inland Spousal Sponsorship

Inland sponsorship applies when the person being sponsored is already in Canada typically on a visitor visa, study permit, or work permit — and will remain in Canada throughout the application process.

Key features:

– The sponsored spouse can apply for a Spousal Open Work Permit (SOWP) at the same time as the sponsorship application, allowing them to work legally in Canada while the application is processed
– The applicant must remain in Canada — international travel may affect eligibility
– Processing generally takes 12 months or more
– Both the sponsorship and the permanent residence application are submitted simultaneously

Best for: Couples who are already living together in Canada and want the sponsored spouse to work while waiting for permanent residence approval.

Outland Spousal Sponsorship

Outland sponsorship applies when the person being sponsored is living outside Canada at the time of application. They may visit Canada during processing but will return to their home country while waiting for a decision.

Key features:
– The sponsored spouse applies for permanent residence from their home country
– There is no restriction on international travel during the process
– The application is processed at a Canadian visa office abroad
– Processing times vary by applicant’s country of origin and current IRCC volumes
– Once approved, the sponsored spouse receives a Permanent Resident visa to enter Canada

Best for: Couples who are separated by international borders and cannot or prefer not to have the sponsored spouse living in Canada during the full process.

What Documents Are Required?

Spousal sponsorship requires extensive documentation to prove the genuine nature of the relationship and the sponsor’s ability to support the applicant. Required documents typically include:

Sponsor documents:
– Proof of Canadian citizenship or permanent residence status
– Financial information (income, tax returns) — note: a specific income threshold is not required for spousal sponsorship, but you must confirm you are not receiving social assistance
– Statutory Declaration of Cohabitation (if applicable)
– Proof of relationship history

Applicant documents:
– Proof of identity (passport, national ID)
– Police clearance certificates from all countries of residence
– Medical examination results (completed by a designated IRCC physician)
– Evidence of genuine relationship: photos, travel records, communication history, joint financial documents, statutory declarations from family and friends

Our team prepares a thorough document checklist tailored to your specific situation. Missing or incorrectly submitted documents are one of the most common causes of delays and refusals.

Spousal Sponsorship Processing Time

Processing times vary depending on whether the application is inland or outland, the volume of applications at IRCC, and the completeness of your submission.

IRCC publishes processing time estimates on their website. Our team provides current estimates at the time of your consultation, based on your specific pathway and profile. See our detailed guide: [Spousal Sponsorship Canada Processing Time] ← internal link.

Why Choose NextArrival Immigration for Spousal Sponsorship?

Legal representation when it matters.
Spousal sponsorship applications are refused more often than people expect — previous sponsorships, gaps in cohabitation, misrepresentation concerns, or admissibility issues can all derail an application. As an immigration lawyer, we identify these risks before filing and, if a refusal or hearing arises, we handle the legal response. You do not need to find a separate lawyer when things get complicated.

Careful document preparation.
We know what IRCC looks for and how to present your case clearly and completely. A well-organised application reduces the risk of delays and procedural requests.

Support through complex cases.
Previous refusals, criminal records, previous sponsorships, or gaps in cohabitation can complicate an application. We identify potential concerns early and address them proactively.

Personal service.
Spousal sponsorship applications involve sharing intimate details of your relationship. Our team handles every case with discretion and genuine care.
